"An Ordinance to amend

I have examined the accompanying Ordinance entitled the Foreign Offenders Detention Ordinance, 1872"

fid I am of opinion that the Ordinance is one which is not contrary to the Governor's Instructions,

Ordinance No. 1 of 1872 permits the Governor to warrant the temporary detention of subjects of Foreign Goverments who, having been accused or con- tricted of crimes committed in China, are brought within the Colony in course

Oving to the of transmission to their own country for trial or punishment.

rowth of consular jurisdiction such persons are tried in their Consular Courts in China more often tahn in their own country and as it is as impor-

tant to detain prisoners being transmitted Fast as it is to detain prisoners being transmitted West the amendments are rade in the proɛrble and in section

3 of the principal Ordinance.

Moreover as the principal Ordinance is not an extraction Ordinance

mit an Ordinance which authorises the detention of prisoners already in law-

1 custody when, in course of transmission, they are brought to the Colors,
